INTELLECTUAL PROPERTY (IP) PROTECTION POLICY

This Intellectual Property Protection Policy (“IP Policy”) is incorporated by reference into the Emerging You LLC Terms & Conditions (“Terms”). By accessing or purchasing any product or service from Emerging You LLC, you agree to be bound by both the Terms and this IP Policy as a single, unified agreement.
1. CONSISTENT DEFINITIONS
For clarity and consistency across all governing documents (including Terms, Privacy Policy, Refund Policy, and this IP Policy):
-“Content” means all materials created or provided by Emerging You LLC, including but not limited to courses, videos, PDFs, downloads, templates, frameworks, coaching materials, funnels, branding, text, graphics, and digital assets.
-“Services” means all digital products, courses, coaching programs, memberships, and related offerings.
-“User,” “You,” or “Client” means any individual accessing or purchasing Services.
-“Company,” “We,” or “Us” means Emerging You LLC.
-“License” means the limited rights granted to use Content under this IP Policy.
2. OWNERSHIP OF INTELLECTUAL PROPERTY
All Content and Services are the exclusive intellectual property of Emerging You LLC and are protected under applicable United States and international copyright, trademark, and intellectual property laws.
Nothing in the Terms or this IP Policy transfers ownership of any intellectual property to you at any time.
All rights not expressly granted are reserved by Emerging You LLC.
3. LIMITED LICENSE (NO TRANSFER OF RIGHTS)
Subject to your continued compliance with the Terms, Emerging You LLC grants you a:
-Limited
-Non-exclusive
-Non-transferable
-Revocable
-Non-sublicensable
-license to access and use the Content solely for personal, non-commercial use.
-This license does not create any ownership interest in the Content.
-This license is automatically revoked upon violation of any provision in the Terms or this IP Policy.
4. STRICTLY PROHIBITED USE (ENFORCEABLE RESTRICTIONS)
You expressly agree that you will NOT, under any circumstances:
-Copy, reproduce, duplicate, or distribute any Content
-Share, sell, rent, or transfer login credentials or access
-Resell, sublicense, or redistribute Content in any form
-Upload or share Content on any website, platform, cloud drive, forum, or group
-Use Content to create competing products, services, or trainings
-Modify, edit, repurpose, or adapt Content for commercial purposes
-Claim ownership, authorship, or affiliation with Emerging You LLC
-Remove copyright, trademark, or proprietary notices
These restrictions apply regardless of intent and whether use is commercial or non-commercial.
5. DIGITAL SECURITY, TRACKING & FRAUD PREVENTION
Emerging You LLC reserves the right to implement reasonable technical, security, and administrative measures to protect its Content, including:
-Access logs and usage monitoring
-IP address tracking and device/session monitoring
-License verification and authentication systems
-Fraud prevention and abuse detection tools
All monitoring is conducted for security, compliance, and enforcement purposes and to the extent permitted by applicable law.
We reserve the right to suspend or terminate access immediately, without prior notice or refund, if we reasonably suspect any violation of this IP Policy or the Terms.
6. ENFORCEMENT, INJUNCTIVE RELIEF & LEGAL ACTION
Violations of this IP Policy or the Terms may result in one or more of the following:
-Immediate termination of access to all Services
-Permanent account suspension without refund
-Civil action for damages, including lost revenue and reputational harm
-Injunctive relief to immediately stop unauthorized use or distribution
-Recovery of attorney’s fees, court costs, and enforcement expenses where permitted by law
You agree that unauthorized use of Content causes irreparable harm to Emerging You LLC for which monetary damages alone may be insufficient, and therefore injunctive relief is appropriate.
Emerging You LLC actively enforces its intellectual property rights and does not waive enforcement by delay, omission, or partial enforcement.
7. DMCA / COPYRIGHT INFRINGEMENT NOTICE
If you believe any Content has been copied or used in a way that constitutes copyright infringement, you may submit a Digital Millennium Copyright Act (DMCA) takedown request to:
Your notice should include:
-Identification of the copyrighted work
-Description of where the infringing material is located
-Your contact information
-A statement of good faith belief that use is unauthorized
-A statement under penalty of perjury that the information is accurate
We will respond to valid DMCA requests in accordance with applicable law.
8. REPORTING INFRINGEMENT
If you identify unauthorized use of our Content outside of DMCA processes, you may report it to:

9. RELATIONSHIP TO TERMS & CONDITIONS (MASTER AGREEMENT CLAUSE)
This IP Policy is incorporated into and governed by the Emerging You LLC Terms & Conditions.
In the event of any conflict between this IP Policy and the Terms, the Terms shall control unless expressly stated otherwise.
No rights are granted to any third party unless explicitly stated in writing.
10. SEVERABILITY
If any provision of this IP Policy is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
11. NO WAIVER
Failure by Emerging You LLC to enforce any provision of this IP Policy or the Terms shall not constitute a waiver of any rights.
Any waiver must be in writing to be effective.
12. ASSIGNMENT RESTRICTION
You may not assign, transfer, or delegate any rights or obligations under this IP Policy or the Terms without prior written consent from Emerging You LLC.
Any unauthorized assignment is void.
13. UPDATES AND MODIFICATIONS
Emerging You LLC reserves the right to update or modify this IP Policy at any time. Updates become effective upon posting.
Continued use of Services after updates constitutes acceptance of the revised IP Policy.
